We advise public (government and other procuring authorities) and private (sponsors, concessionaires, lenders and contractors) stakeholders on the procurement, financing, completion, purchase and sale of complex "public-private partnership" (P3) projects throughout the US and globally.
Unique Breadth of Experience
Active in the US P3 sector since its inception, our team has acted on the successful procurement and execution of many of the largest and most innovative "first of its kind" P3 projects in the market, involving a wide range of delivery models and assets.
We have advised on projects procured through all manner of P3 delivery models, from competitive bids to expedited pre-development agreement processes, and utilizing Design-Build-Finance-Operate-Maintain (DBFOM), Design-Build-Operate-Maintain (DBOM), Build-Operate-Transfer (BOT) and hybrid structures.
Our experience includes advising on P3 projects used to procure a wide variety of public assets in the transportation infrastructure sector (e.g., toll roads, bridges, commuter rail, ports and airports, parking facilities), the social infrastructure sector (e.g., courthouses and public administration buildings, student housing, convention centers), energy generation and efficiency projects and a diverse range of other assets, such as fiber optic networks, data storage and "smart" traffic lighting.
Efficiency Informed by Experience
The breadth of our experience affords us unique insight into the factors that contribute to a successful P3, and allows us to efficiently advise on appropriate structure and risk allocation that both achieves the key criteria of the procuring authority and is acceptable to investors and financeable by lenders.
This efficiency of experience is critical, as differences in procuring authority priorities/statutory constraints and the EPC/operations requirements of the asset being procured rarely allow for a "one size fits all" approach towards procurement structure, selection procedures, risk allocation and availability of sources of financing.
